Are there rules for which lectures are automatically set for review?

My first lecture in section 2 is set for review and I can't turn it off. Are there rules as to which lectures are automatically set for review? I thought this was entirely my choice?
The rule is that you must have ten minutes of lectures that are open to review. So, if you only have ten minutes of lectures posted, they will all be open to review. Once you have an hour, lets say, then you can choose which ones will be for review.
If that is the rule it is not working correctly. I have several courses loaded - well over the 10 minute mark. Only one is forced on and it is under 7 minutes.
If the minimum is 10 minutes than a second one should also be forced to on, but it is not. I can turn all of the others on or off.
